Terms of Service

These terms govern your use of valour-store.com and any purchase from VALOUR (Mitchum Procter, sole trader, Sydney, Australia). By using the store or placing an order you agree to them.

1. Products

VALOUR sells handcrafted Eau de Parfum. We describe and photograph products as accurately as we can; colours and packaging may vary slightly from images. Fragrance is a personal experience and scent perception varies between people.

2. Our scent names

VALOUR scents (Pearl, Luna, Cipher, Rosa, Onyx, Empire, Cove, Forge) are our own original names. We are an independent brand and are not affiliated with, endorsed by, or connected to any designer fragrance house. Any reference to a well-known fragrance, if made, is for honest descriptive comparison only.

3. Eligibility

You must be able to form a legally binding contract to purchase. Products are intended for adult use.

4. Pricing & GST

Prices are shown in Australian dollars (AUD). VALOUR is currently not registered for GST, so prices do not include GST. We may change prices at any time, but changes don't affect orders already accepted.

5. Orders & acceptance

Your order is an offer to buy. A confirmation email acknowledges receipt; the contract forms when we dispatch the goods. We may decline or cancel an order (e.g. pricing error, stock, suspected fraud) and will refund any payment if we do.

6. Payment

Payment is taken at checkout through our payment providers. You confirm you're authorised to use the payment method.

7. Delivery & risk

We deliver per our Shipping Policy. Risk in the goods passes to you on delivery. Title passes once we've received full payment.

8. Your consumer rights (Australian Consumer Law)

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You're entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You're also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure isn't major. Nothing in these terms limits those rights. 10. Intellectual property

The VALOUR name, logo, lockups, artwork, text and images are our property or licensed to us. You may not copy or use them commercially without our written permission.

11. Acceptable use

Don't misuse the store (no fraud, scraping, interfering with security, or unlawful use).

12. Liability

Nothing in these terms excludes rights you have under the ACL. To the extent permitted by law, our liability for a failure to comply with a consumer guarantee (other than guarantees of title) is limited, at our option, to replacing the goods or refunding the price. We're not liable for indirect or consequential loss to the extent the law allows.

13. Third-party links

The store may link to third parties; we're not responsible for their content or practices.

14. Force majeure

We're not liable for delays or failures caused by events beyond our reasonable control.

15. Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that jurisdiction.
